Terms of Service

1. Agreement

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. The Services

Arenci is a fashion shopping agent. Features may include:

• Text or photo search across third-party product listings.
• Personalised discovery experiences, including For You, Daily Edit, and Hunts.
• Saving items as Finds and building a style profile.
• Sharing product links.
• With Arenci Plus, tracked items that are checked for better matches or price changes over time.

Product listings, prices, availability, images, and shop details may come from third-party merchants, marketplaces, or catalog partners.

• Products are not currently sold by us. When you open a merchant link, you leave our Services and that merchant’s terms and privacy policy apply to browsing and any purchase.
• Search results, rankings, and tracking suggestions are informational. They may be incomplete, outdated, or wrong. Always verify details before buying.

The Services currently include our website and the iOS app. If we make Arenci available on other platforms later, these Terms apply to those versions as well unless we post different terms.

Arenci previously offered checkout for a limited set of physical goods. Any legacy order remains governed by the terms presented when it was placed and our Shipping and Returns page.

3. Eligibility

You must be at least 16 years old (or the higher minimum age required in your country, if any) to use the Services. By using the Services, you represent that you meet this age requirement. If you use the Services on behalf of another person or organisation, you represent that you have authority to accept these Terms on their behalf.

4. Accounts and security

You may need an account to use certain features. Sign-in may use phone verification, Sign in with Apple, Google, or other methods we enable. You must provide accurate information and keep it up to date.

You are responsible for activity under your account and for keeping your credentials and devices secure. Do not share your account. Notify us promptly of any unauthorised use at aryan@arenci.app.

We may suspend or restrict access if we reasonably believe there is a security risk, a violation of these Terms, or a risk of harm to other users, merchants, or the Services.

5. Arenci Plus subscriptions

Arenci offers free features and a paid subscription called Arenci Plus. Plus unlocks paid features described in-app, including an ad-free experience and tracking, subject to any stated feature limits.

Plus subscriptions are billed by the platform store. Arenci does not currently take payment for physical goods in the app.

5.1 How billing works

• Paid subscriptions are sold through the platform store from which you install the app. Today that is the Apple App Store. Arenci Plus is not purchased on the marketing website.
• Subscriptions renew automatically until you cancel in your device or App Store subscription settings (or the equivalent store settings if we later offer the app on another platform).
• Where a free trial is offered (for example a 7 day introductory trial), you can cancel before the trial ends to avoid being charged, subject to the store’s rules.
• Prices and plan options are shown in the app and store listing and may vary by region and currency.
• Refunds, billing disputes, and payment method management are handled primarily under the rules of the platform store and applicable law.

5.2 Changes and access

We may change subscription prices or feature packaging from time to time. Where required, the store or we will provide notice, and new prices apply on the next renewal so you can cancel if you disagree. Plus access lasts while your subscription (including an active trial entitlement) remains valid. If a payment fails, we may downgrade or suspend paid features until payment succeeds.

5A. Advertising in the free service

The free service may contain clearly labelled third-party ads, including in discovery feeds, search and Lens results, and Daily Edit. Ads are selected and served by Google and its advertising partners.

• An ad is not an endorsement by Arenci. The advertiser is responsible for its claims, products, and destination.
• Ad availability, placement, and format may vary. Choosing non-personalised or limited advertising where available does not necessarily remove ads from the free service.
• Plus is ad-free while your Plus entitlement remains active.

6. Acceptable use

You agree not to:

• Use the Services unlawfully or for fraudulent purposes.
• Upload content you do not have the right to use, or that is illegal, harmful, defamatory, or infringes others’ rights.
• Attempt to disrupt, scrape at scale without permission, reverse engineer (except where applicable law allows), or gain unauthorised access to the Services or related systems.
• Misrepresent your identity or affiliation, or use the Services to spam or harass others.
• Interfere with billing, trials, entitlements, or tracking systems, or attempt to obtain paid features without authorisation.
• Use automated means to overload the Services or extract data in a way that harms performance or violates these Terms.

We may remove content, limit features, or suspend or terminate access if we reasonably believe you have violated these Terms or created risk for users, partners, or the Services.

7. User content and AI outputs

You may provide input to the Services (“Input”), including search queries, photos, profile details, preferences, and feedback. The Services may return results, rankings, recommendations, tracking matches, and similar material (“Output”). Input and Output together are “User Content” for purposes of this section, except that merchant product data remains owned by the relevant third parties.

You retain ownership of Input you create, to the extent permitted by law. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and otherwise use Input solely to operate, secure, personalise, and improve the Services, and to comply with law. You represent that you have the rights needed to provide Input and grant this licence.

Output may be generated or assembled using AI systems and third-party catalogs. Due to how AI and shared catalogs work, Output may not be unique, and different users may see similar results. You are responsible for how you use Output.

When you use the Services you understand and agree that:

• Output may not always be accurate, complete, or current. Do not rely on it as the sole source of truth about products, prices, or availability.
• Output is not professional advice (including fashion, financial, or legal advice).
• You should evaluate results with ordinary care before purchasing or sharing them.

8. Intellectual property

The Services, including Arenci branding, software, design, and documentation, are owned by Nirvana AI Technologies Ltd or our licensors. These Terms do not transfer ownership of those rights to you. Merchant product content remains subject to the rights of those third parties.

If you send us feedback or suggestions about the Services, you grant us a perpetual, royalty-free right to use that feedback without restriction or compensation to you.

9. Third-party services and links

The Services may link to or rely on third-party sites, apps, product catalogs, visual-search providers, advertising, sign-in providers, analytics, messaging, and store platforms. We are not responsible for third-party content, products, availability, or practices. Your dealings with third parties are solely between you and them, under their terms and privacy policies.

• Some product links may be affiliate or partner links. We may receive compensation if you buy through certain links.
• That does not change the price you see from the merchant unless the merchant says otherwise.
• Ads may link to an advertiser's destination. Arenci is not the seller and is not responsible for a transaction with that advertiser.

10. App distribution (Apple)

If you download Arenci from the Apple App Store, you acknowledge that these Terms are between you and Nirvana AI Technologies Ltd, not Apple. Apple is not responsible for the app or its content. Your use of the iOS app must also comply with Apple’s applicable usage rules. Apple has no obligation to provide maintenance or support for the app. To the extent any warranty claim arises that Apple is required to address under its rules, Apple’s responsibility is limited as set out in Apple’s terms; otherwise, we are responsible for the app as between you and us under these Terms.

11. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that search results, prices, availability, tracking alerts, or other Output are complete, accurate, or current, or that the Services will be uninterrupted or error-free.

Nothing in these Terms excludes any consumer right that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Nirvana AI Technologies Ltd and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the 12 months before the claim or (b) £50.

Nothing in these Terms excludes or limits liability that cannot be limited under applicable law (including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for breach of the statutory terms about title, description, quality, and fitness for purpose in consumer sales of goods).

13. Responsibility for misuse

To the extent permitted by law, you are responsible for claims, losses, and expenses arising from your misuse of the Services, your Input, or your violation of these Terms, including reasonable legal fees where recoverable. This does not require you to take on liability that applicable consumer law does not allow us to impose.

14. Suspension, termination, and discontinuation

You may stop using the Services at any time. You may request account deletion as described in our Privacy Policy and Account deletion page. Cancelling Arenci Plus is done through your platform store subscription settings. Obligations relating to any legacy order, including legally required record retention, survive account deletion.

We may suspend or terminate your access, or delete an account, if we determine that you breached these Terms, that we must do so to comply with law, or that your use creates risk or harm to us, our users, or others. We may also discontinue the Services in whole or in part. If we discontinue a paid Service you prepaid for, we will provide any refund required by law or store rules for unused prepaid periods.

15. Changes

We may update the Services or these Terms. We will post updated Terms on this page and revise the effective date. If you continue to use the Services after changes take effect, you accept the updated Terms where permitted by law. If you do not agree, stop using the Services.

16. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you may benefit from mandatory protections of your local law and courts.

17. General

These Terms are the entire agreement between you and us regarding the current Services and supersede prior agreements on the same subject. Terms presented for a legacy physical-goods order continue to govern that order. If a provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganisation or sale of assets. You must comply with applicable export and sanctions laws.
